Supreme Court Hands Biden Border Policy Victory

Texas and Louisiana efforts to hold the Biden administration accountable for its unworkable immigration policy suffered a fatal blow on Friday. The U.S. Supreme Court overwhelmingly ruled the states did not have legal standing to sue over the White House plan.

A Texas-based federal judge ruled last June in favor of the states, effectively blocking the policy’s implementation. It had been enforced less than a year before that ruling.

But now the floodgates are reopened for Washington to revert to protocols that theoretically prioritize public safety threats. And while this may sound reasonable, in practice it means that a blind eye will be turned to millions of illegal migrants.

By following this policy, the White House said it was using its limited resources to focus on criminals crossing the border. 

This conveniently denies the fact that every illegal migrant commits a criminal act by entering the country.

The 8-1 ruling was authored by Justice Brett Kavanaugh, who called the lawsuit by Texas and Louisiana “extraordinarily unusual.” He wrote that the states attempted to “order the executive branch to alter its arrest policies so as to make more arrests.”

Kavanaugh added that it is not standard procedure for federal courts to hear such cases.

As president of the most powerful nation in the world, Joe Biden in 2021 implemented his new immigration plan based on the premise that the U.S. is unable to deport everyone it should.

Therefore, it will instead focus attention on those illegal migrants deemed to be public safety threats and effectively ignore the rest. This represented a drastic change from the border control policies of former President Donald Trump and led to unprecedented numbers of unlawful crossings.

Of course, the high court decision was welcomed with open arms by open borders advocate and Homeland Security Secretary Alejandro Mayorkas. 

Parroting the Biden immigration theme, he said the revived policy will permit border officials “to focus limited resources and enforcement actions on those who pose a threat to our national security, public safety, and border security.” 

The lone dissent came from Justice Samuel Alito. He declared that the Supreme Court in effect decided that the only limit on a president ignoring the law is “Congress’ power to employ the weapons of inter-branch warfare.”

In other words, the court rolled out the red carpet for Biden to disregard federal immigration law and pick and choose who will be allowed to stay within U.S. borders illegally.
